1. Introduction
Welcome to SkinCura Tokyo ("SkinCura," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our personalized skin diagnosis service (the "Service") through our website skincuratokyo.com (the "Site").
By creating an account, making a purchase, or otherwise using our Service, you ("you," "your," "Client") agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.
These Terms should be read together with our Privacy Policy, which describes how we collect, use, and protect your personal data.
2. About Us (The Service Provider)
The Service is operated by:

"SkinCura Tokyo" is a trademark and service brand owned and operated by HadAI Works LLC.
3. Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts in your jurisdiction
- Provide accurate and complete information when registering and during the diagnosis process
- Not be prohibited from using the Service under applicable laws
The Service is intended for individual personal use only. Commercial use, resale, or use on behalf of others is not permitted without our prior written consent.
4. Description of the Service
SkinCura provides personalized skin diagnosis reports based on:
- Photographs you upload (face and wrist)
- Questionnaire responses you provide
- Review and analysis by our certified beauty specialists ("diagnosticians")
We currently offer three plans:
- Skin Analysis — A one-time, in-depth skin diagnosis report
- Total Beauty — Skin Analysis plus makeup strategy, color correction guidance, foundation matching, and 30 days of WhatsApp specialist access (3 questions)
- Beauty Monthly — Ongoing monthly diagnosis with progress tracking

5. Important: This Is Not Medical Advice
SkinCura is a beauty and skincare consultation service. It is NOT a medical service.
You acknowledge and agree that:
- Our reports do not constitute medical diagnosis, medical advice, or medical treatment
- Our diagnosticians are beauty and skincare specialists, not medical doctors or dermatologists
- For any skin condition involving pain, infection, severe inflammation, suspected disease, allergic reactions, or any other medical concern, you must consult a qualified medical professional (such as a dermatologist)
- We do not prescribe medications or recommend medical procedures
- Any product or ingredient recommendations we make are general beauty suggestions, not medical prescriptions
- You are solely responsible for your decisions regarding your skin and overall health
If you experience any adverse reaction, irritation, or other negative effect from following our recommendations, you should immediately discontinue use and consult a medical professional.
6. Account Registration and Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately at support@skincuratokyo.com of any unauthorized access
We reserve the right to suspend or terminate your account if we have reasonable grounds to believe that:
- You have provided false or misleading information
- You have violated these Terms or our Privacy Policy
- You have engaged in fraudulent activity, abuse, or harassment
- You have repeatedly initiated unjustified chargebacks
- You have uploaded photographs of any person other than yourself without their explicit consent
7. Payment Terms
7.1 Currency and Processing
Payments are currently processed in USD ($) via Stripe. INR (₹) amounts displayed on our website are approximate, for reference only. The exact INR amount charged to your account depends on your bank's USD-INR exchange rate at the time of transaction, plus any foreign transaction fees your bank may apply (typically 1-3%).
We are working to enable direct INR billing through Razorpay in the future. The Privacy Policy provides additional details on payment processing.
7.2 Pricing
Current pricing for each plan is displayed on our website. We reserve the right to change pricing at any time, but changes will not affect purchases already made.
7.3 Founding Clients Offer
The Founding Clients Offer is available to the first 30 clients only and provides:
- 30% discount on your first purchase
- 30% permanent discount on all future SkinCura services
- A handwritten thank-you note from our founder
- Direct access to our founding specialist
Once 30 clients have claimed Founding status, the offer will close. The discount applies automatically at checkout while spots remain available.
7.4 Subscriptions (Beauty Monthly)
Beauty Monthly is a recurring monthly subscription that automatically renews each month until canceled. You may cancel at any time. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused portions of a paid month.
8. Refund Policy
We aim to be fair and transparent. Our refund policy is structured as follows:
8.1 Before Report Delivery
If you have not yet received your diagnosis report, you may request a full refund within 7 days of purchase by contacting support@skincuratokyo.com. We will process the refund within 14 business days.
8.2 If You Have Not Submitted Photos or Questionnaire
If you have purchased a plan but have not yet submitted your photos or questionnaire, you may request a full refund at any time before submission, regardless of the 7-day window.
8.3 After Report Delivery
Once your diagnosis report has been delivered, refunds are evaluated on a case-by-case basis. We will consider partial or full refunds in cases of:
- Demonstrable quality issues with the report (e.g., factual errors, missing sections)
- Failure to deliver the promised service features
- Other clear service defects
To request post-delivery refund consideration, contact support@skincuratokyo.com within 7 days of report delivery, providing specific details of the issue.
8.4 Non-Refundable Situations
The following situations are not eligible for refunds:
- Subjective dissatisfaction (e.g., "the foundation color recommendation didn't match my preference")
- Results not meeting expectations due to non-adherence to our recommendations
- Adverse reactions caused by products you purchased independently based on our suggestions
- Beauty Monthly subscriptions beyond the first month (you can cancel future renewals; past months are non-refundable)
- Charges related to currency conversion or foreign transaction fees imposed by your bank
8.5 Chargeback Disputes
If you initiate a chargeback through your bank without first contacting us, we may suspend or terminate your account and decline to provide further service. We always prefer to resolve issues directly.
9. Intellectual Property
9.1 Our Content
All content on the Site and within your diagnosis reports — including text, design, graphics, methodology, recommendations, and reports — is the intellectual property of HadAI Works LLC, protected under copyright and other applicable laws.
You are granted a personal, non-transferable, non-exclusive license to use your diagnosis reports for your own personal, non-commercial use. This includes:
- Reading and following the recommendations
- Printing the report for personal reference
- Showing the report to family, friends, or your personal medical/beauty advisors
You may not:
- Publish, post, or distribute the report or its contents on social media, blogs, or any public platform
- Sell, license, or transfer the report to any third party
- Use the report or its contents to create derivative works for commercial purposes
- Remove or alter any copyright, trademark, or attribution notices
9.2 Your Content
You retain ownership of the photographs and information you provide to us. By using the Service, you grant us a limited license to use this content solely for the purpose of providing the Service to you, as detailed in our Privacy Policy.
9.3 Trademarks
"SkinCura" and "SkinCura Tokyo" are trademarks of HadAI Works LLC. You may not use these marks without our prior written permission.
10. WhatsApp Specialist Access (Total Beauty Plan)
The Total Beauty plan includes 30 days of WhatsApp access to your founding specialist, subject to the following terms:
10.1 Usage Limits
- Maximum 3 questions per 30-day period
- The 30-day period begins on the date your diagnosis report is delivered
- Unused questions do not roll over
10.2 Response Time
We aim to respond within 24 hours on business days (Monday through Friday, Japan Standard Time, excluding Japanese national holidays).
10.3 Permitted Topics
WhatsApp questions must relate to:
- Clarification of your diagnosis report
- Implementation guidance for recommended skincare or makeup techniques
- Product alternatives within recommended categories
10.4 Excluded Topics
We do not respond to questions regarding:
- Medical conditions or medical advice (please consult a doctor)
- Detailed reviews of products or brands not covered in your report
- Personal counseling, emotional support, or non-skincare topics
- Services or products of competitors
10.5 Misuse
We reserve the right to revoke WhatsApp access without refund if you engage in:
- Harassment, abusive language, or inappropriate communication
- Excessive messaging beyond the 3-question limit
- Sharing the WhatsApp contact with third parties
- Using the channel for purposes outside the permitted scope
11. Acceptable Use
You agree not to:
- Upload photographs of any person other than yourself
- Provide false, misleading, or fraudulent information
- Use the Service in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to our systems
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated tools (bots, scrapers) to access the Service
- Interfere with or disrupt the Service or our infrastructure
Violation of this section may result in immediate account termination without refund.
12. Disclaimers and Limitation of Liability
12.1 Service Provided "As Is"
The Service is provided on an "as is" and "as available" basis. While we strive to provide high-quality, personalized advice, we make no warranties that:
- The Service will meet your specific expectations or aesthetic goals
- The recommendations will produce specific visible results within any timeframe
- The Service will be uninterrupted, error-free, or completely secure
12.2 No Guarantee of Results
Skincare results vary significantly based on individual skin types, lifestyle, environment, product quality, and consistency of use. We do not guarantee specific outcomes from following our recommendations.
12.3 Limitation of Liability
To the maximum extent permitted by applicable law:
- Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us for the specific service giving rise to the claim
- We are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, lost data, or emotional distress
- We are not liable for any harm resulting from products you purchase from third-party retailers based on our recommendations
This limitation does not apply to liability that cannot be excluded under applicable law (such as gross negligence, willful misconduct, or consumer protection rights that cannot be waived).
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms are governed by and construed in accordance with the laws of Japan, without regard to conflict of law principles. However, mandatory consumer protection rights afforded to you under the laws of your country of residence (including the Digital Personal Data Protection Act, 2023 of India for Indian users) shall continue to apply where they cannot be waived by contract.
13.2 Initial Dispute Resolution
If you have any concern or dispute, please contact us first at support@skincuratokyo.com. We commit to:
- Acknowledging your concern within 7 business days
- Working in good faith to resolve the matter within 30 days
13.3 Jurisdiction
Subject to mandatory consumer protection laws in your country of residence, any unresolved dispute arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the Tokyo District Court (東京地方裁判所) in Tokyo, Japan.
You acknowledge that this venue is reasonable given that:
- HadAI Works LLC is established and operates in Japan
- The Service is designed and provided from Japan
- This provision does not prevent you from exercising consumer rights available in your country of residence
14. Changes to These Terms
We may update these Terms from time to time to reflect:
- Changes in our Service or business practices
- Changes in applicable law
- Improvements based on user feedback
When we make material changes, we will:
- Update the "Last Updated" date at the top of these Terms
- Notify you via email at least 30 days before the changes take effect for substantive changes
- Request renewed acceptance for any new obligations that materially affect your rights
Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and may request account closure.
15. Termination
15.1 Termination by You
You may stop using the Service and request account closure at any time by contacting support@skincuratokyo.com. Account closure does not automatically refund any outstanding payments; refund eligibility is determined by Section 8.
15.2 Termination by Us
We may suspend or terminate your access to the Service at any time, with or without notice, for any of the reasons listed in Section 6 (Account Registration and Security) or Section 11 (Acceptable Use), or for any other material violation of these Terms.
15.3 Effect of Termination
Upon termination:
- Your right to use the Service ceases immediately
- We may retain your data as described in our Privacy Policy
- Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, governing law, and dispute resolution) shall remain in effect
16. Miscellaneous
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and HadAI Works LLC regarding the Service, superseding any prior agreements.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
16.3 No Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
16.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any successor entity (such as in connection with a merger, acquisition, or corporate reorganization) without restriction.
16.5 Language
These Terms are originally drafted in English. Any translation provided is for convenience only; in case of discrepancy, the English version prevails.
